This Terms and Conditions document ("Terms") is a legal agreement between you (the "User") and Scholar Tech Innovations Private Limited ("Company", "we", or "us"). By accessing or using our website T-10.in or the associated mobile applications Cricstars and DreamTeam (collectively, the "Platform" or "Services"), you agree to be bound by these Terms, as well as our Privacy Policy and any other policies referenced herein. If you do not agree with these Terms, you must not use the Platform. These Terms are published in compliance with the New Zealand Consumer Guarantees Act 1993, Fair Trading Act 1986, and Privacy Act 2020 as an "electronic record" and do not require any physical or digital signatures.

1. Company Details

Name: Scholar Tech Innovations Private Limited
Registered Address: 18 Glamis Avenue, Dinsdale, Hamilton 3204, New Zealand
Website: T-10.in
Associated Apps: Cricstars (mobile application) and DreamTeam (mobile application; currently non-functional).

Scholar Tech Innovations Private Limited is the owner and operator of the T-10.in website and the above apps, which provide a global cricket platform connecting players, tournaments, and fantasy cricket contests. The Company's identifying details are provided here in compliance with the New Zealand Consumer Guarantees Act 1993 and Fair Trading Act 1986. For any questions or concerns about these Terms, you may contact us at the address above or via email at Info@t-10.in.

2. User Agreement and Eligibility

2.1 Acceptance of Terms

By creating an account or using any part of the Platform, you acknowledge that you have read, understood, and agree to these Terms and our Privacy Policy. This user agreement is legally binding. You also agree to comply with all applicable laws and regulations while using our Services. If you do not agree to any of these conditions, you should refrain from using the Platform.

2.2 Eligibility (Age and Jurisdiction)

  • Age Requirement: You must be at least 18 years old to register an account or use the Platform's services. The Platform is not intended for minors. By accepting these Terms, you represent and warrant that you are 18 years of age or older and competent to enter into a contract under New Zealand law. If you are below 18, you are not permitted to use the Platform. The Company reserves the right to verify your age at any time and suspend/terminate accounts of users who are minors.
  • Jurisdictional Restrictions: Our Services are intended to comply with the laws of New Zealand. If you are accessing the Platform from a region with laws or regulations governing online content, games, or services that differ from New Zealand, you are responsible for ensuring that your use is lawful in your jurisdiction. In particular, if you are using the DreamTeam fantasy cricket app, you confirm that participating in skill-based fantasy sports contests is legal in your jurisdiction. Users from territories where online skill gaming or related activities are prohibited by law are not permitted to participate in such contests. The Company does not knowingly allow usage of the Platform in any region where it would violate local law.

2.3 Account Registration

  • Account Creation: To access certain Services, you will be required to create an account with accurate, complete, and up-to-date information. This may include providing your full name, email address, mobile number, and setting a password. You agree to provide truthful information during registration and to keep your account information updated. You may be required to verify your email or phone number via OTP (one-time password) or other verification methods. The Company reserves the right to refuse registration or cancel an account if we discover it was created with false information or otherwise violates these Terms.
  • One Account Rule: Each user is allowed to create only one individual account. You must not create multiple accounts or impersonate any other person or entity. Accounts are personal to the registrant and must not be sold, leased, shared or transferred to others without our written approval. You are also not allowed to use the account of another person.
  • Account Security: You are responsible for maintaining the confidentiality and security of your account login credentials. Any activity performed through your account will be deemed to have been done by you. You must keep your username and password secure and not share them with anyone else. If you suspect any unauthorized access to or use of your account, you must immediately notify the Company at Info@t-10.in. While we employ reasonable security measures, we cannot guarantee that the Platform is immune from unauthorized access, and we disclaim liability for any loss or damage arising from unauthorized use of your account due to your failure to secure your credentials.
  • Account Usage and Responsibility: You agree to use your account for personal, non-commercial use unless expressly permitted by the Company (for example, if you are an authorized representative of a franchise or tournament organizer on our Platform). You are responsible for all activities that occur under your account. All information and content you provide or generate on the Platform must comply with these Terms. The Company will not be liable for any loss or damage arising from your failure to comply with these account requirements.

3. Financial Transactions

3.1 Payments and Fees

Our Platform may offer both free and paid services. Certain features, tournaments, or contests (for example, entry into cricket tours or fantasy cricket contests on DreamTeam) may require payment of fees. All prices, fees, charges, and payment terms will be specified on the Platform or in related service-specific rules. By making a payment, you agree to the pricing and payment terms applicable to that service or event.

  • Payment Methods: Payments on the Platform must be made through the authorized payment gateways or methods we provide (such as credit/debit cards, online banking, digital wallets, etc.). We use trusted third-party payment processors that adhere to New Zealand financial regulations for secure handling of payments. All transactions are encrypted and processed over secure connections.
  • User Responsibility for Payment: You must use your own valid payment instrument (card, bank account, wallet etc.) for making payments. By providing payment information, you represent that you are authorized to use the payment method and you authorize the Company or its payment processor to charge the full amount due for the selected service or purchase.
  • Invoices and Taxes: Where applicable, the Company will issue electronic invoices or receipts for any fees paid. All fees are inclusive of any applicable taxes (unless otherwise stated). If any taxes (such as Goods and Services Tax) are applicable to your purchase or winnings, we will deduct or add such taxes as required by New Zealand law.

3.2 Refunds and Cancellations

All payments made on the Platform are generally final. We have a no-refund policy for services that have been fully delivered or used, except in the following cases or as required by New Zealand consumer law:

  • Event/Contest Cancellation: If the Company cancels a cricket tour, tournament, or fantasy contest (for example, due to insufficient participants, technical error, or force majeure circumstances), users who paid an entry fee or purchase for that specific event may be eligible for a refund of that fee.
  • Withdrawal of Contest Entry: If you have paid to join a contest (like a fantasy match) and you withdraw or cancel your entry before it begins (and if the platform's rules allow withdrawal), any refund of the entry fee will be governed by the contest rules.
  • Erroneous/Accidental Transactions: In case of a confirmed duplicate payment or an obvious error in billing (for instance, you were charged but did not receive the intended service), please contact our support with details.

No Chargebacks Abuse: If you dispute a transaction (chargeback) with your bank without valid cause, we reserve the right to suspend your account pending resolution. We encourage users to first contact us to resolve any payment issues.

4. Privacy Policy

Your privacy is important to us. Our Privacy Policy explains in detail how we collect, use, store, and protect your personal information. By using the Platform, you consent to the collection and use of your data in accordance with the Privacy Policy and the New Zealand Privacy Act 2020. The following is a summary of key privacy terms:

Data Collection and Usage

  • Data Collection: When you register or use our Services, we collect information that you provide directly (such as your name, email, phone number, date of birth, address, profile details, etc.). We also collect data automatically about your use of the Platform – for example, device information, IP address, browser type, usage statistics, and cookies.
  • Use of Data: We use your information to provide and improve our Services. This includes using data to create and manage your account, allow you to participate in tournaments or contests, display leaderboards or match data, process payments and withdrawals, communicate with you about your account or new features, provide customer support, and personalize your experience on the Platform.

Privacy Concerns: If you have any concerns or grievances regarding privacy or your personal data on our Platform, you may contact us at Info@t-10.in. You also have the right to lodge a complaint with the New Zealand Privacy Commissioner if you believe we have breached the Privacy Act 2020.

5. User-Generated Content and Moderation

The Platform may allow users to create, submit, share, or display content such as profile information, text posts, images, videos, comments, forum messages, match scores, statistics, team selections (in fantasy contests), and other materials ("User-Generated Content" or "UGC"). This section outlines the rules and your rights and responsibilities regarding UGC:

5.1 Ownership of Content

You retain ownership of any original content that you post on the Platform, to the extent you have intellectual property or other rights in that content. The Company does not claim ownership over your UGC. However, by posting or sharing content on our Platform, you grant the Company a worldwide, royalty-free, non-exclusive, sublicensable license to use, reproduce, distribute, adapt, modify, publish, translate, create derivative works from, display, and perform your content in connection with providing the Services and promoting our Platform. For example, this license allows us to display your posts to other users, include your content in feature highlights or advertisements for the Platform, or make backups of it on our servers.

You represent and warrant that you have all necessary rights to post the content you share and to grant us the above license. You also agree that this license includes the right for other users of the Platform to view and use your content (for example, other participants can view the scores you input for a match, or see your posts in a forum, etc.), in accordance with these Terms.

5.2 Community Guidelines for Content

All UGC must adhere to the standards set out in Section 2.4 (User Conduct and Prohibited Activities). In summary, you must ensure that any content you create or share on the Platform:

  • Does not contain any prohibited content types (illegal, harmful, defamatory, obscene, hateful, infringing, or otherwise unlawful content).
  • Is accurate (to the best of your knowledge) when it consists of factual claims or data. For example, if you are updating match scores or statistics, you should not deliberately post incorrect information.
  • Does not violate any confidentiality or privacy rights.
  • Respects intellectual property rights: Only upload content that you created or have permission to use.

We encourage healthy and sportsmanlike communication. Content that is abusive or disruptive to the community experience can lead to moderation actions.

6. Liability Limitations

6.1 Disclaimer of Warranties

Platform Provided "As Is": The Services, including all content, functions, and features made available on or through the Platform, are provided on an "as is" and "as available" basis. To the extent permitted by New Zealand law, including the Consumer Guarantees Act 1993, the Company disclaims all warranties of any kind, whether express or implied, statutory or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, title, and non-infringement.

No Professional Advice: Any information or advice that may be available on the Platform or through user communications is for general informational purposes only. You should not rely on it as professional advice.

Consumer Rights: Nothing in these Terms limits or excludes any rights you may have under the Consumer Guarantees Act 1993 or Fair Trading Act 1986. If you are acquiring our services for business purposes, the Consumer Guarantees Act 1993 does not apply.

7. Dispute Resolution

We are committed to resolving disputes quickly and fairly. This section describes the agreed method for dispute resolution between you and the Company:

7.1 Initial Resolution

Most concerns can be resolved by contacting our support team. You agree to first attempt to resolve any dispute, claim, or controversy informally by contacting us and providing a description of your issue. You can email us at Info@t-10.in or use the contact information provided in Section 1.

7.2 Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of New Zealand. You agree to submit to the non-exclusive jurisdiction of the New Zealand courts for any disputes arising under or in connection with these Terms or your use of the Platform.

8. Compliance with New Zealand Laws

Our Platform is operated in New Zealand and is in compliance with the laws and regulations of New Zealand. We place great emphasis on adhering to all relevant statutes to ensure a safe, fair, and legally compliant experience for our users.

  • Fair Trading Act 1986: We adhere to the Fair Trading Act 1986, which prohibits misleading and deceptive conduct, false representations, and unfair practices in trade.
  • Privacy Act 2020: We comply with the Privacy Act 2020, which governs how we collect, use, store, and disclose personal information. Our Privacy Policy outlines our practices in detail.
  • Gambling Act 2003: Our fantasy sports contests are designed to be games of skill rather than chance, in compliance with New Zealand gambling laws. However, users should be aware of their local laws regarding participation in such contests.

For any complaints or concerns about our compliance with New Zealand laws, please contact us at Info@t-10.in.

9. Termination and Amendments

9.1 Termination of Accounts

By User: You have the right to stop using our Services at any time. You may delete your account through the account settings (if available) or by contacting us with a request to delete your account.

By Company: We reserve the right to suspend or terminate your account or your access to all or part of the Platform at our discretion, with or without notice, if we believe you have violated these Terms or any applicable law.

9.2 Updates and Amendments to Terms

We may revise or update these Terms and any policies linked to them (including the Privacy Policy) from time to time to reflect changes in our services, user feedback, or changes in law. Whenever we make material changes to these Terms, we will provide notice to users by posting the updated Terms on our website (and/or within the app) and updating the "Last Updated" date at the top.

Your continued use of the Platform after the updated Terms have been posted will constitute your acceptance of the changes. If you do not agree with any amended Terms, you should stop using the Services and, if necessary, terminate your account.

By using the T-10 Platform (website or apps), you acknowledge that you have read, understood, and agree to all of the above terms and conditions. We appreciate your cooperation and wish you a safe and enjoyable experience on our Platform. Thank you for being a part of our community.
